Esto se debe a que el trabajador no est\u00e1 dado de alta en la <a href=\"https:\/\/www.seg-social.es\/wps\/portal\/wss\/internet\/Inicio\">Seguridad Social<\/a><\/span><span style=\"font-weight: 400;\">, lo que significa que no recibe los beneficios y protecciones laborales que otorga el Estado<\/span><span style=\"font-weight: 400;\">. Esto tambi\u00e9n significa que el empleador no est\u00e1 cumpliendo con sus obligaciones legales<\/span><span style=\"font-weight: 400;\">, lo que puede resultar en sanciones econ\u00f3micas<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">Adem\u00e1s, el trabajador sin contrato no tiene acceso a la protecci\u00f3n social<\/span><span style=\"font-weight: 400;\">, a la cobertura de Fogasa (Fondo de Garant\u00eda Salarial)<\/span><span style=\"font-weight: 400;\">, a la incorporaci\u00f3n en prevenci\u00f3n de riesgos laborales<\/span><span style=\"font-weight: 400;\">, a la protecci\u00f3n extensiva<\/span><span style=\"font-weight: 400;\"> y a la incorporaci\u00f3n de derechos de plena igualdad<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">Aunque actualmente haya una importante econom\u00eda sumergida, con un alto porcentaje de empleadas del hogar trabajando sin estar registradas, los riesgos de contratar una interna o externa sin cumplir las exigencias de la legislaci\u00f3n laboral son graves.<\/span><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/maidsespana.es\/wp-content\/uploads\/2023\/01\/eb3b8cf7-66c2-4124-a112-8f7025637ef1.jpeg\" alt=\"Riesgos de tener una empleada de hogar sin contrato\" title=\"\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Sanciones por contratar una empleada de hogar sin contrato<\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">Cualquier persona puede iniciar el tr\u00e1mite de inspecci\u00f3n de trabajo (incluido el empleado en situaci\u00f3n irregular), y la responsabilidad recae \u00edntegramente sobre el empleador.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">Las sanciones por este tipo de infracci\u00f3n aparecen recogidas en la Ley sobre Infracciones y Sanciones en el Orden Social (LISOS).<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400;\">Multas por no pagar las cotizaciones de la Seguridad Social: Trabajar sin estar dado de alta puede suponer una sanci\u00f3n entre 751 y 7.500 euros, si el infractor regulariza la situaci\u00f3n por voluntad propia, y de entre 7.501 y 12.000 euros (por trabajador) si la regularizaci\u00f3n se produce tras una inspecci\u00f3n de trabajo.<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400;\">Multas por las cuotas dejadas de percibir: al detectarse cualquier irregularidad en el pago de cuotas, las Seguridad social puede reclamar los pagos no percibidos durante el tiempo que ha durado la relaci\u00f3n laboral (con car\u00e1cter retroactivo a los 4 a\u00f1os anteriores), aplicando recargos de hasta el 20%.<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400;\">Multas por no tener permiso de trabajo: trabajar en Espa\u00f1a sin los permisos obligatorios en vigor o en situaci\u00f3n irregular supone una multa de desde los 7.501 a los 225.018 euros.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400;\">As\u00ed que si a\u00fan no tienes una empleada del
